Pyromania Takeover

Have you contacted your local press about this? Since the St. Louis Post-Dispatch wrote the event up 2018 in this way, the situation would seem fairly clear-cut, unless of course you've signed contracts that say otherwise.

"Pyromania” is not your average fireworks show. For one, the show that the Missouri Pyrotechnic Association will put on Saturday at Cedar Lake Cellars in Wright City is much, much larger.

Organizer and professional pyrotechnician Rob Cima puts things in perspective:

“The average fireworks display that you might see in a town on the Fourth of July might have two to four pyrotechnicians working on it. We’re going to have over 150 pyrotechnicians from 20 states in working on this event.”

Carl Bolm, the proprietor of Cedar Lake Cellars, says he was blown away when his winery hosted the event for the first time last year. He describes the experience as the Fourth of July “times 10.”

I bet a bunch of you guys feel like prostitutes. They are the pimps. You did all the work and they got the money.

When you been in it for a while and while volunteering and loving it and doing it as a hobby- Murphy has a way of rearing its ugly head. You have these slimbags that will take advantage of pyro's doing it for the love of the trade. You guys built it up while they were taking the credit all the time.

Now, things have changed- they were hoping to do the shell game and get 10,000's of people with them thinking they were going to see the same amazing show as years past. Yes, they will have a bunch of people walk away shaking their heads, But people are complacent, they will be back the next year and be happy because the show that year will be better than the year before, and so on.

When you get down to attorneys, judges, and a jury- How much is it worth to you guys? I think I would rather spend money on advertising state wide-don't mention the CLC. If Pyromania was your title- use it. Don't get into the slander garbage. Just come out and say Pyromania is going to be held "here and on this date" and get as much FREE media as you can, DO NOT MENTION CLC no matter what.

At this point it sounds like mopyro needs to be meeting with a lawyer and getting legal advice.... hopefully to go after clc hard.
 
I think it would be difficult to trademark Pyromania, as it is a medical/pyschological term. It is used to describe a rare, pathological disorder characterized by intentional and repeated fire setting. People with pyromania are deeply fascinated by fire and related paraphernalia. They may experience feelings of satisfaction or a release of built-up inner tension or anxiety once a fire is set. Maybe MO Pyro could trademark the name "MO Pyro's Pyromania", or something to that effect. I doubt CLC is going to get very far trying to trademark "Pyromania", for starters every psychiatrist writing an article on this condition would have to get permission from CLC to use the name/term "Pyromania".

I disagree here and fully expect the trademark to be granted as filed (for use as name of a firework event). There's already one active trademark of "Pyromania" for the use of a type of flower's name and at least one other trademark which was granted and is now inactive (although I don't remember what use the trademark was granted under). Just because a word has a definition doesn't mean it can't be trademarked for a certain use.
 
Could I be so bold as to suggest a GoFundMe campaign for the pyro community to donate for MO Pyro's legal expenses. Just so you know, I spoke with the CLC owner last week. He talks a good talk but leaves out some details. I think MO Pyro is being screwed, but it comes down to what was in writing and agreed upon/signed by both parties. Carl claims he was granted a 5 year license to the Pyromania name. If so, why the attempted trademark registration? I have Pyromania t-shirts dating back to 2014. I think that establishes precedence in using the name, as well as newspaper reporting and pyro trade journal reporting on the event. I'd gladly contribute $200 to fight this shrewd businessman if I can be assured MO Pyro didn't accidentally give away the shop in writing.
 
Bolm has trademark on it now... see attachments. Claimed he first used the name January of 2017.

THIS TRADEMARK REGISTRATION CAN BE CHALLENGED! Who has MO Pyro's ear? It is so incredibly easy to disprove their claim of using pyromania to describe a fireworks event. They just have to get off their butt and do it! Don't let this jackass bully you guys around. Fight back!

FYI, Cedar Lake has filed a lawsuit against MOpyro demanding that *we* stop using the name, and claiming that we owe them over $100k. They have further suggested that it should be on us to pay Premier's bill since they had to go to the trouble of finding someone new. Its all bull, but his objective is only to make it expensive for us to defend we believe. He has asked for a jury trial to add to the cost.

Will MO Pyro please respond? Are you going to challenge CLC's damn assertion of trademark on the name Pyromania? As an annual participant in Pyromania I'll challenge it myself if you won't, I'm so pissed off by this f-tard! He claims first use in 2017. Hell! I have Pyromania t-shirts from 2014! I'm sure we can uncover some news reporting from 2014 on the event. First use my ass! Such a thick prick this guy is!
 
Here is how you go about opposing a trademark registration. Remember, CLC has only submitted an application for trademark. It can be opposed and THEY CAN BE DENIED the trademark.

About the Trademark Trial and Appeal Board

The Trademark Trial and Appeal Board (the TTAB or the Board) is a neutral body that functions like a court for trademark matters at the USPTO. The Board's administrative trademark judges are authorized to determine a party's right to register a trademark with the federal government. The Board is not authorized to determine whether you have the right to use a trademark, just whether you have the right to register it. Additionally, the Board is not authorized to determine questions of trademark infringement or unfair competition or to award money damages or attorney's fees. For anything other than determining the right of federal registration, you must file a case in federal or state court.

While the Board is authorized to handle five different types of cases, there are three main categories of proceedings that applicants and registrants should know about: appeals, oppositions, and cancellations. Please be aware that if you file a case at the TTAB or if someone files a case against you at the TTAB, you will be a party to a legal proceeding.

Oppositions
Another common Board proceeding is an "opposition." In an opposition, a person may oppose (or "object to") the trademark application of another party in order to stop that party from obtaining a federal registration. Before a trademark can register, the mark must be published for opposition in the Official Gazette. Publication starts the opposition period, which initially lasts 30 days, but may be extended. During the original opposition period, any party who believes that it would be damaged if the published mark registers may oppose registration. Although there are many possible grounds for opposition, the most common one is a claim that a likelihood of confusion exists between the trademarks.

In this type of proceeding, a three-judge panel issues a decision after both sides have had an opportunity to present their evidence and make arguments in legal briefs before the Board. The issues and procedures can be very complex and the experience is similar to a civil court case.
